What Kelly Glen Estates's governing documents say
This is a declaration of covenants, conditions, and restrictions for the Kimball Glen Subdivision, a single-family residential community in Grapevine, Texas. It establishes an owners' association with mandatory assessments and an architectural control committee. All lots are restricted to single-family detached homes only.
- Residential use: Each lot may be used only for single-family residential purposes. Duplexes, apartments, garage apartments, and commercial uses are prohibited.
- Minimum home size: The main dwelling on any lot must have at least 2,500 square feet of heated and air-conditioned floor space.
- Garages: Every residence must provide a garage with space for at least two automobiles. Garage doors require Architectural Control Committee approval.
- Architectural review: All exterior construction, additions, fences, walls, and landscaping changes must be approved in writing by the Architectural Control Committee (ACC) before starting. Plans are reviewed within 30 days.
- Assessments: The association levies annual maintenance assessments and may levy special assessments. Unpaid assessments accrue interest at 18% per year and become a lien on the lot, enforceable by foreclosure.
- Fencing: Fences require prior ACC approval. Perimeter fences facing streets, parks, or open spaces must be rod iron. Privacy fencing is allowed only between individual lots.
- Signs: No signs or flags may be displayed without ACC approval, except holiday or patriotic flags and signs by the Declarant during development.
- Solar panels: Solar energy devices may be installed with ACC approval, subject to restrictions on location (roof or fenced yard) and visibility; they must not reduce energy production more than 10% compared to optimal placement.
