Walnut Creek Valley is a single-family residential subdivision in Mansfield, TX, governed by protective covenants that run with the land. These rules apply to all lot owners and are not a condominium or rental community. The documents cover architectural standards, land use restrictions, and certain maintenance obligations, but do not establish an active homeowners' association or set assessments.
- Architectural review: No building may be erected or altered until plans and specifications (including location, design, and materials) are approved in writing by the developer. Approval is deemed given if the developer fails to act within 30 days after submission, or if no suit to enjoin construction is filed before completion.
- Building standards & minimum size: Main structures must be single-family dwellings no more than two stories. At least 75% of first-floor exterior walls must be brick, stone, or similar masonry. Roofing must be wood shingle, slate, concrete, tile, or comparable approved materials. Minimum heated & air-conditioned floor area varies by lot (e.g., 1600 sq ft for one-story, 1200 sq ft for multi-story in certain blocks).
- Fences & setbacks: Fences cannot be placed nearer to the street than the front of the dwelling, nor closer than 15 feet to a golf course property line, and cannot exceed 6 feet in height. On lots abutting the golf course, fences within 20 feet must be of open construction (wrought iron, open picket) that does not block the view. Chain link or wire fencing is prohibited. All fences require developer approval.
- Pets & animals: No livestock, poultry, or other animals may be raised or kept, except dogs, cats, or other household pets, provided they are not maintained for commercial purposes.
- Signs: Only one sign of no more than six square feet advertising the property for sale or rent is allowed, plus signs approved by the developer during construction or sales periods.
- Parking & vehicles: No trailers, boats, boat trailers, mobile homes, or commercial trucks may be parked where visible from the front street, except while actively loading or unloading. No vehicles transporting flammable or explosive cargo may be kept in the subdivision. Abandoned or inoperative vehicles may not be stored in view from the front street.
- Utilities: All utility lines must be installed underground and made as inconspicuous as possible, unless the developer gives prior written consent otherwise.
- Covenant duration & amendments: These covenants run with the land for 35 years from recording, with automatic 5-year renewals unless a majority of lot owners vote to change them. The developer may amend the covenants alone as long as it owns any property in the section; afterwards, 51% of owners may amend with the developer's consent if it still owns property.
