What Shoal Ck 6 Owners's governing documents say
This is the Bylaws of the Shoal Creek 6 Owners Association, a property owners association (HOA) for a single-family residential development in Plano, Texas (partly in Collin and Denton counties). The bylaws govern the internal operations of the association and apply to all lot owners and occupants. They work alongside the Declaration of Covenants, Conditions & Restrictions, which contains the actual use restrictions.
- Board of Directors: The board consists of 3 directors serving staggered 2-year terms. At least a majority must be association members or their spouses. Directors can be removed by a two-thirds vote of members present at a meeting, or by the remaining directors for specific reasons (e.g., delinquency, non-attendance).
- Meetings of the Association: An annual meeting is held in October. Special meetings can be called by the board or by petition of at least 20% of lot owners. Quorum is 20% of lots in person or by proxy; if not met, a reconvened meeting within 15–30 days needs only 10%. Members may vote by written proxy valid for up to one year.
- Rulemaking & Enforcement: The board may adopt, amend, or terminate reasonable rules for administration, maintenance, and resident welfare, with at least 10 days' notice to owners. Violations can result in fines or self-help abatement after a written violation notice and opportunity for a hearing within 30 days.
- What this document doesn't cover: These bylaws don't contain specific use restrictions (e.g., pets, leasing, parking, architectural standards, age limits). Those rules are found in the Declaration or separately adopted rules. The bylaws focus on association governance and enforcement procedures.
