Wind River Estates is a standard single-family homeowners' association (HOA) in Denton, TX. This document is a supplement containing several specific policies adopted by the HOA board, not the full set of governing rules. These policies cover how the association manages records, processes owner requests, handles delinquent payments, and regulates certain property modifications and displays.
- Records retention: The HOA must retain governing documents permanently; financial records, tax returns, budgets, and contracts for at least 7 years; owner account records (ledgers, violations, fines) for 5 years; executed contracts longer than 1 year for 4 years after expiration; and meeting minutes for 7 years.
- Inspecting & copying records: Owners may request to inspect or copy the HOA's books and records. Standard paper copies cost $0.10 per page. The HOA charges $15.00 per hour for labor to locate, compile, and reproduce records, plus a 20% overhead charge on labor. The HOA may require prepayment of estimated costs.
- Payment plans for delinquent assessments: Owners who are behind on assessments may request a 6-month payment plan requiring an initial payment of 25% of the total owed, with equal monthly installments thereafter. A monthly monitoring fee of at least $5.00 applies. Late fees are waived during the plan, but interest and administrative costs continue.
- Solar energy devices: Owners may install solar devices on their roof or in a fenced yard/patio, subject to restrictions: the device must not extend beyond the roofline or be visible from the street in certain ways; frame and wiring must be silver, bronze, or black; and prior written approval is required.
- Rainwater collection: Rain barrels or rainwater harvesting systems are allowed but not on property owned by the Association or common areas, and not between the front of the home and the street. The device must match the home's color scheme and not display extraneous language. Prior written approval from the Board or architectural committee is required.
- Roofing materials: The HOA cannot prohibit an owner from installing shingles that are wind/hail resistant, provide greater energy efficiency, or enable solar generation, as long as the shingles resemble those used in the subdivision, are of equal or superior quality, and match the surrounding aesthetics.
- Flag display: Owners may display flags of the U.S., Texas, or any branch of the U.S. armed forces, subject to rules: maximum flagpole height of 20 feet, only one flagpole per property, flag size no larger than 3 feet by 5 feet, and no nuisance lighting. Prior written approval is required for installation.
- Religious item display: Owners or residents may display religious items on the entry door or door frame, but the total size of all displayed religious items must not exceed 25 square inches. Items must not threaten safety, violate law, contain offensive content, or extend past the door frame.
