What Caruth Terrace #3's governing documents say
This document is an amendment to the restrictive covenants of Caruth Terrace No. 3, a subdivision in Dallas County, Texas. It allows church use on specific lots (the 'Affected Lots') and outlines development rules for that use. It does not replace the original covenants and applies only to a subset of lots, not the entire subdivision.
- Purpose of amendment: The amendment modifies the existing restrictive covenants to permit church use (including a parking phase and fellowship hall) on designated Affected Lots.
- Affected lots: Applies only to Lots 1, 2, 3, 4, 5, 8, 24, and 25 of Block A/2956. Other lots in Caruth Terrace No. 3 are not affected by this amendment.
- Approval requirements: Any further development of the Affected Lots (beyond what is shown on Exhibit A) requires written approval from 70% of all lot owners in Caruth Terrace No. 3 subdivision.
- Construction timeline: Construction must follow a phased schedule: Phase 1 (Parking Phase) and Phase 2 (Fellowship Hall Phase). Each phase must be completed within 365 days of starting actual construction. Phase 2 cannot begin until Phase 1 starts.
- Traffic and access: General vehicular traffic to and from the Affected Lots must use Abrams Road, not Springside Lane. Construction vehicles and pedestrian traffic must also use Abrams Road. Parking on Springside Lane or other public streets is still allowed.
- Maintenance during construction: An 8-foot-tall plywood construction fence must be erected around the site, with gates as needed for equipment. The existing structures must not be demolished in a way that creates an unobstructed view from Springside Lane to Abrams Road; a physical barrier at least 8 feet high must be maintained until construction starts.
- What this document doesn't cover: This amendment does not address typical HOA rules like pet limits, leasing restrictions, or maintenance obligations for the subdivision as a whole. Those rules are in the original restrictive covenants, which are not included here.
