What South Village's governing documents say
South Village at Watermere is a 55+ age-qualified single-family home community in Southlake, TX. It is governed by a homeowners' association (HOA) that maintains common areas and enforces rules. Residents must be at least 55 years old, and occupancy is restricted to qualifying residents and certain family members.
- Age restriction (55+): At least one permanent occupant must be 55 or older (Qualifying Resident). A spouse of any age and a dependent relative 35+ may also occupy. Upon death or divorce of the Qualifying Resident, the spouse may remain. Owners must verify ages and report changes within 20 days.
- Leasing & rentals: Leases are allowed only to tenants who meet the age requirement (Qualifying Resident). Leases must be in writing and state the age restriction. The owner assigns all amenity rights to the lessee and must notify the association before the lessee uses the Amenity Center.
- Club membership (optional): Each Qualifying Resident (and spouse) may purchase a nontransferable Club Membership from the developer, granting access to the Clubhouse Facilities. Membership requires a Club Participant Fee and monthly Club Services Fees.
- Assessments & fees: The HOA levies annual assessments and may levy special assessments. Assessments are per Lot and become liens if unpaid. Owners are personally obligated for assessments. Resale certificate fees and transfer fees may also apply.
- Common areas & Amenity Center: Common areas (e.g., open space, private streets) are maintained by the HOA. The Amenity Center (tennis court, pavilion, walking trails, lakes, parks) is not part of the HOA's common area and is shared under a separate Covenant to Share Costs with the adjacent condominium association.
- Architectural review: An Architectural Control Committee (ACC) must approve exterior changes or construction. Owners must submit plans for prior approval. Variances may be granted but no waiver of future approvals.
- Maintenance responsibilities: The HOA maintains common areas (e.g., landscaping, private streets). Owners are responsible for their Lot and Residence, including interior, exterior, and yard maintenance. Improper maintenance may be corrected by the HOA at the owner's cost.
- Enforcement & fines: The HOA may impose fines, suspend services, tow vehicles, and record liens for violations. Owners must receive notice and a hearing before most sanctions. The HOA is not obligated to enforce, but owners may enforce after 15 days of written request.
