What Hunter Pointe Homeowners''s governing documents say
These documents are individual covenant agreements recorded against specific lots in the Hunter Pointe community (Euless, TX). They are not the community's governing documents (CC&Rs) but rather waivers of builder warranties and releases of construction-defect claims. They bind each subsequent owner of the affected lot, requiring them to release all claims against the builder and waive various warranties.
- Who is bound: All subsequent owners who acquire title to the property after the covenant is recorded are automatically bound by its terms.
- Release of claims: Owners forever release all claims (known or unknown) against the builder for construction defects, including foundation and other defects, whether now or in the future.
- Waiver of warranties: All express and implied warranties are canceled, including the implied warranty of habitability, good workmanship, and fitness for a particular purpose. The HOME of Texas/Residential Warranty Corp. ten-year warranty is also surrendered.
- Covenant not to sue: Owners agree not to sue, pursue, or assign any claim or cause of action against the builder in court, arbitration, or otherwise.
- Transfer requirement: Sellers must provide a copy of the covenant to the buyer before conveying the property, but failure to do so does not invalidate the covenant.
- Builder identity: For most lots, the builder is Weekley Homes, L.P. (David Weekley Homes). One document identifies the builder as Sovereign Homes Corporation and its affiliates.
