St Joseph Estates HOA is a single-family homeowners association in North Richland Hills, TX. This document is an addendum to the CC&Rs that imposes strict rental restrictions; it does not provide the full set of HOA rules. Homeowners are bound by these rental limits, and renters must follow HOA rules enforced via the owner.
- Leasing & rentals: Leases must be for at least 1 year (365 days). Short-term rentals (less than 1 year), house swapping, and room rentals to non-relatives are prohibited. Owners must have lived in the property for at least 1 year before renting. Only 2 units in the community may be rented at the same time (cap).
- Renter requirements & owner liability: Before leasing, the owner must provide the Board with a notarized document confirming tenants were informed of HOA rules, a list of tenant names/contact, a criminal background check, and a non-sublet clause. Owners are fully liable for any HOA rule violations by their tenants.
- Criminal background checks: A criminal background check must be performed; results must be provided to the Board. The HOA cannot blanket-ban individuals with criminal history; each application is reviewed case-by-case based on severity and recency of the crime.
- Exceptions & appeals: Renting a room to a dependent child, relative, home health professional, or nanny is exempt from the rental process (only notice to Board required). Other special circumstances may be appealed to the Board.
- Transfer fees: Property transfer fees: $150 transfer fee, $250 resale certificate, $100 initial contribution. These cover the association's costs related to property transfers.
