Newport Village at Trinity is a standard homeowners association (HOA) for a residential subdivision in Euless, TX. These documents are the Bylaws and Rules that govern the HOA, binding all homeowners. They cover association governance, property standards, and enforcement procedures.
- HOA membership & meetings: Every homeowner is a member. Annual meetings are held; special meetings can be called by the president, a majority of the board, or members holding at least 20% of votes. A quorum is 10 members present (or 25% for elections). Members may vote by proxy.
- Board of directors: The board has 3–5 directors, each serving staggered 2-year terms. Directors serve without compensation. The board may remove a director for missing 3 consecutive meetings, 75% of meetings in a year, being over 60 days delinquent on assessments, or being subject to an enforcement action.
- Assessments & finances: Monthly assessments are $25. The board must prepare annual financial reports (income statement, cash receipts/disbursements, variance report, balance sheet, delinquency report). The board may borrow for common element repairs without member approval; other borrowing requires member approval like a special assessment.
- Property maintenance & nuisances: Homeowners must keep lots free of rubbish and debris. Grass/weeds over 12 inches in front or fence-height in back are nuisances. Fines start after a 10-day notice: $5/day for front grass (up to 30 days, then HOA may mow at owner's expense), $5/day for back. Bulk trash pickup week is an exception.
- Pets & animal noise: Homeowners must immediately clean up pet droppings on common area; $50 fine per instance. Excessive barking, yelping, or howling for more than 30 minutes in an hour is a nuisance. After notice and 2 weeks to correct, a $50/week fine applies.
- Parking & vehicles: Fire lanes (marked by red curbs/signage) are strictly no parking at any time – vehicles may be towed immediately at owner's expense. Junk cars (inoperable, abandoned, or without current registration) get a 45-day notice before towing; owner pays all towing/storage fees. Trash cans left out after Thursday may incur a $25 fine.
- Enforcement & fines: Violations typically start with a certified letter notice. Fines for illegal dumping: $250. For obstructing fire lane painting: special assessment equal to contractor's return fee divided among responsible owners. Other specific fines noted above. The HOA may also report illegal dumping or code violations to the city.
