What Viridian Village 2C's governing documents say
These documents are not a full community rulebook. They are individual property-specific Declarations of Restrictive Covenants that impose a mandatory arbitration requirement on the owner and all future owners or occupants of the lot in Viridian Village 2C. The arbitration covers any dispute related to the purchase, construction, or repair of the home. The documents do not contain typical HOA rules like pet restrictions, rental limits, or architectural guidelines.
- Mandatory arbitration: Any claim or controversy arising out of or relating to the home purchase contract, construction, or repair must be settled by binding arbitration under the Federal Arbitration Act. This includes claims against the seller, builder, subcontractors, and other third parties joined in the arbitration. The arbitration agreement runs with the property for 15 years after closing.
- Who is bound: The buyer, their successors and assigns, and any future owner or occupier of the property are bound by the arbitration provisions. By accepting a deed or occupying the property, the holder irrevocably agrees to abide by the declaration.
- Duration of the covenant: The declaration has a term of 15 years from the closing date. After that, it automatically expires, except for arbitration or legal proceedings already in progress at the time of expiration.
- What this document doesn't cover: This is not a full set of community covenants. It does not address common HOA topics such as pet limits, rental restrictions, parking rules, architectural review, maintenance obligations, or assessments. Those rules, if any, would be in a separate master declaration for Viridian Village 2C.
