This document is an arbitration-only covenant recorded for individual lots within the Viridian Village 2D subdivision (Arlington, TX). It does not set community rules or restrictions—it simply requires that any dispute between the owner and the builder (Coventry Homes) be resolved through binding arbitration instead of court. The covenant runs with the land for 15 years from the original closing date.
- Mandatory arbitration: All claims or controversies relating to the home’s purchase, construction, or repair must be settled by binding arbitration under the Federal Arbitration Act, not by a lawsuit. This applies to the original buyer and all future owners and occupants for 15 years.
- Term and expiration: The arbitration covenant lasts 15 years from the original closing date, then automatically expires. It also terminates if the builder (Declarant) reacquires the property.
- Arbitration procedures: Either party may demand arbitration; it will be held in the federal judicial district where the property is located. Arbitrators must be Texas attorneys with at least 20 years of single-family residential construction experience. The prevailing party can recover attorney’s fees and costs incurred in compelling arbitration.
