Ascot Heath is a single-family homeowners association (HOA) in Fairview, TX. You own your lot and house; the association maintains common areas and enforces the rules. All owners are automatically members and must pay annual assessments.
- Single-family residential use: Each lot is limited to one single-family residence only. No townhomes, duplexes, apartments, or multiple-family units. Minimum 3,000 sq ft of living space. Mobile homes and manufactured housing prohibited. All residences must be newly constructed on the lot.
- Architectural controls: All exterior construction, alterations, and improvements require prior written approval from the Architectural Control Committee (ACC). Plans not approved within 30 days are deemed approved. Exterior materials must be brick, stone, or stucco. Accessory buildings must match residence materials. Driveways must be concrete, brick, or stone. Retaining walls must be railroad ties or brick/stone veneer. Light posts required at driveway entrance, no taller than 4 ft. Fences must be wrought iron or combination with masonry; no chain-link, barbed wire, or wood.
- Assessments & fees: Annual assessments are set by the Board, with a 10% annual increase cap unless approved by two-thirds of members. Late fee: $15 per month. Unpaid assessments become a lien on the property with 18% annual interest. Special assessments require two-thirds member vote. The association can foreclose after two years of delinquency.
- Parking & vehicles: Every home must have a garage accommodating at least two cars. Carports not permitted; garage door cannot face a street. No trailers, RVs, boats, or recreational vehicles allowed on the lot except behind the front building line or in the garage. No parking on public streets. Wrecked, junked, or inoperative vehicles prohibited.
- Pets: Only dogs, cats, or generally-recognized household pets permitted. No livestock, poultry, exotic, or dangerous animals.
- Maintenance responsibilities: Owners must keep their lot, buildings, and grounds well-maintained, including lawn mowing, tree pruning, watering, repainting, and repair. Failure allows the association to enter and perform work, charging the owner, with lien rights.
- Enforcement & fines: Violations trigger a 30-day cure notice. If uncured, the association can fine $200 plus $5 per month until remedied. Unpaid fines become a lien. Owners have appeal rights to the full membership before legal action.
