These are the Bylaws of Malibu Estates Homeowners' Association, a single-family home HOA in Flower Mound, TX. They govern how the association is run — including board elections, meetings, and enforcement procedures. Actual neighborhood rules (e.g., landscaping, parking, pets) are in a separate Declaration of Covenants, Conditions and Restrictions, which is not fully included here.
- Board of Directors: The Board has 3–5 seats. Initially, the developer appoints all members; after 99% of lots are sold, owners elect some directors. Directors must be owners or spouses, must be current on assessments, and cannot be in litigation against the association.
- Association Meetings & Voting: Annual meetings are held. Quorum is 20% of votes for regular meetings, 30% for special. One vote per lot; lots owned by the developer get 5 votes each. Proxies are allowed but expire after 11 months. Owners delinquent 45 days or more may be barred from voting.
- Fines & Enforcement: Fines cannot exceed $500 per violation occurrence. Before fining, the association must give written notice and a 10-day cure period. Owners can request a hearing within 30 days. Recurring violations within 6 months are subject to immediate fines.
- Owner Obligations: Owners must notify the association before selling (at least 10 business days), provide contact info and driver's license within 30 days of purchase, and keep their mailing address current. Failure to pay assessments can result in loss of voting rights.
- Association Records & Resale Certificates: The association keeps minutes, financial records, and owner lists. Owners can inspect records for a proper purpose and obtain copies at reasonable cost. Resale certificates are available for a fee, and the association may refuse to issue them until the fee is paid.
