Ederville Park Townhomes is a townhome community in Fort Worth, TX, governed by a homeowners' association. This 2020 amendment to the community's governing rules adds specific restrictions on leasing and residential use. It binds all homeowners (owners of lots/dwellings).
- Residential use & business activities: All lots must be used for single-family residential purposes only. Home-based businesses are allowed if they are not apparent by sight, sound, or smell, do not involve client visits, and are ancillary to residential use. Short-term rentals (less than 12 months) and boarding/rooming houses are explicitly prohibited.
- Leasing & rentals: Leases must be for a minimum initial term of 12 months (unless the Board approves a shorter term). New owners cannot lease their dwelling for the first 12 months after purchase (hardship exceptions possible). All leases must be in writing and cover the entire dwelling—no subleasing or renting out part of the unit. Owners must provide copies of the lease and governing documents to the association and to tenants.
- Tenant & occupant qualifications: Owners must provide a criminal background report for every adult occupant. Leasing to anyone convicted of specific felonies (including crimes against persons, sex crimes, drug offenses, theft, burglary, etc.) is prohibited. Occupancy cannot exceed city of Fort Worth code limits.
- Hardship leasing: The Board may allow leasing before the 12-month waiting period or in other situations upon written application showing undue hardship (e.g., inability to sell at market value, owner's death, military deployment, or leasing to an immediate family member). The Board determines the lease duration.
