This is a builder's restrictive covenant and agreement for a specific lot (Lot 14, Block 2) in Lake Vista Estates, Fort Worth, TX. It is not a full HOA rulebook but a recorded document between the builder (Sandlin Homes) and the original homeowner that primarily addresses construction warranties, dispute resolution, mold prevention, and drainage. It binds current and future owners because it runs with the land.
- Dispute resolution: mandatory arbitration & waiver of jury trial: All disputes between the owner and builder must first be mediated, then resolved by binding arbitration under the Federal Arbitration Act. The owner cannot sue in court; any litigation in violation entitles the other party to recover costs and attorney's fees. The owner also waives the right to a jury trial if arbitration is unenforceable.
- Limited warranty & builder's repurchase option: Builder gives only a written limited warranty (no implied warranties). For the first 5 years, if repair costs for a construction defect exceed 30% of the home's fair market value, the builder may elect to buy back the property at the original purchase price plus closing costs, permanent improvements, moving expenses, and attorney's fees.
- Owner's maintenance responsibility for mold / moisture: The builder disclaims all warranties for mold or biological impurities. The owner is responsible for maintenance to prevent mold growth, including vacuuming, ventilation, promptly drying wet materials, and repairing leaks. Porous materials with mold should be discarded.
- Drainage & grading: The property has an approved grading and drainage plan. Any future construction (fences, landscaping) by the owner that disrupts drainage may cause flooding or settlement; the owner bears that risk.
- Insurance waiver of subrogation: Both parties waive subrogation rights against each other for insured losses to the property or improvements. If the owner receives payment from a third party for a dispute, the owner must indemnify the builder against claims from that third party.
