Lake Port Village, Section 2 is a single-family residential subdivision in Arlington, TX, governed by a Declaration of Covenants, Conditions, and Restrictions (CC&Rs). This document sets rules for lot use, construction, and property maintenance for homeowners, but does not establish a homeowners association or impose assessments. It is recorded in Tarrant County and runs with the land.
- Residential use & building restrictions: All lots must be used for residential purposes only. Only single-family dwellings with a private garage (2+ cars) are allowed, and no building may exceed two stories. Minimum floor space is set by City of Arlington ordinances. No commercial, institutional, or non-residential uses.
- Architectural Control Committee (ACC) approval: No building, fence, wall, or other improvement may be erected or altered without written ACC approval. The ACC reviews plans for quality of materials, design harmony, drainage, and compliance with this declaration and any design guidelines. The ACC can grant variances and may charge fees for review.
- Construction requirements: All dwellings must be completed within 12 months of construction commencement. Exterior walls and roofing must comply with applicable fire codes and City of Arlington ordinances. Driveways and sidewalks must be reinforced concrete. Temporary structures (tents, trailers) are prohibited without ACC approval.
- Fencing & landscaping: Fences must be wood, with finished side facing neighboring lots, and cannot exceed 6 feet in height. Chain link fences are allowed temporarily during construction only. Owners must keep weeds cut, maintain ground cover, and keep all improvements in good repair. No clothes hanging devices are allowed outside.
- Parking & vehicles: No vehicles over 1 ton may be parked on streets or driveways. No inoperable or unlicensed vehicles may be kept outside a garage. Repair work on vehicles is only allowed inside a fully enclosed garage. Boats, trailers, and recreational vehicles must be stored in a garage or screened from view.
- Signs & antennas: Only one professional sign (max 9 sq ft) per lot for builder advertising, one for-sale or for-rent sign (max 9 sq ft, ground-mounted, max 3 ft high), and security company signs are allowed. Political signs may be placed 30 days before an election. Antennas and satellite dishes are restricted in size and location.
- Pets: Dogs, cats, and other household pets are allowed but cannot be kept for commercial breeding or maintenance. No livestock or poultry.
- Duration & amendments: This declaration runs for 25 years from the recording date (1999), then automatically renews for successive 10-year periods unless owners of all lots consent to abolish. During the first 10 years, Declarant can amend without owner consent (except for certain sections); after 10 years, owner consent is required for amendments.
