South Meadow is a single-family residential subdivision in Fort Worth, TX, governed by a declaration of covenants, conditions, and restrictions. It also includes provisions for duplex lots with party walls. - Architectural review & building approval: All buildings and alterations must be approved in writing by a Building Committee as to cost, quality, materials, design harmony, and location relative to topography and finished grade. If plans are not submitted, a suit to enjoin must be filed before completion to avoid approval.
- Use restrictions & residential character: Lots are for single-family residential use only. No trade, noxious activities, oil/mining operations, or commercial raising of animals are allowed; only dogs, cats, or other household pets may be kept, and not for commercial purposes. Dumping rubbish or keeping waste except in sanitary containers is prohibited.
- Parking & vehicle restrictions: Trucks over three-quarters ton cannot park overnight on streets, driveways, or within the subdivision. Vehicles carrying inflammable or explosive cargo are never allowed, and trailers, motor homes, tents, shacks, recreational vehicles, boats, campers, or junk vehicles may not be stored or parked in the open on any lot.
- Building standards & minimums: Dwellings must have at least 900 square feet of floor area (excluding porches, garages, breezeways), at least 60% masonry exterior, and roofs of wood shingle, shake, clay or concrete tile, or composition approved by the committee. Driveways and walks must be cement, asphalt, or brick. Landscaping requires sod front yards, two 3-inch caliper trees, and 10 bushes before closing.
- Fences & landscaping: Fences, walls, or mass plantings of shrubs or hedges on interior lots are restricted in character and height relative to set-back lines; on corner lots, they are restricted between the front and side street property lines. A single small sign (e.g., for sale or contractor) is permitted.
- Party walls & shared fences (duplex lots): For duplex lots, owners share equally the cost of repairing or rebuilding party walls and separating fences after damage, unless one owner's negligence caused the damage, in which case that owner bears the full cost. Owners cannot alter party walls or fences, must maintain their own roofs, and disputes go to arbitration with binding decisions.
- Enforcement: Any owner may enforce these covenants by court action, and the prevailing party is entitled to recover court costs and reasonable attorney's fees. The covenants run with the land and bind all owners, successors, and assigns.
