Stewart Creek Estates is a single-family residential HOA in Frisco, TX, governed by a Declaration of Covenants, Conditions, and Restrictions (CC&Rs). This document binds all lot owners to a set of use, maintenance, and assessment rules, and it establishes the HOA's powers. It's a standard HOA rulebook for homeowners and prospective buyers.
- Property use & restrictions: Lots are for single-family residential use only. No multi-family dwellings, businesses, or further subdivision are allowed. Only a private dwelling, patio walls, pool, customary outbuildings, garage, servants' quarters, or guest house may be built.
- Pets: No animals, livestock, or poultry may be raised or bred, but up to three dogs, cats, or other household pets are allowed, provided they aren't kept for commercial purposes and don't create a nuisance.
- Architectural standards: Roofs must have a minimum pitch of 6/12 and be three-tab compositional shingles in earth-tone colors. All dwellings must face the street, meet building setback lines, and be landscaped with at least one live oak tree (3" caliper) and 5-gallon bushes in the front yard. Front and corner side yards must be sodded to the curb.
- Maintenance obligations: Owners must keep their lots and buildings well-maintained, including mowing, pruning, watering, removing trash, and repairing exterior damage. If the owner fails to do so after notice, the HOA can enter the property, perform the work, and charge the owner.
- Assessments & fees: Each lot pays an annual assessment set by the HOA board. The maximum was $150 in 2000, and can increase up to 15% per year without a member vote. Special assessments require a two-thirds vote. Unpaid assessments accrue 18% interest and become a lien on the property, enforceable by foreclosure.
- Leasing & rentals: The document does not restrict leasing or renting lots. Renters are considered occupants and must comply with the rules, but there are no lease term minimums or rental caps.
- Vehicles & storage: Boats, houseboats, sailboats, or similar watercraft must be kept in an enclosed garage or screened behind a solid fence behind the building line. No trailers, tents, or temporary structures may be used as residences, except during construction.
- Signs & antennas: Signs are limited to temporary 'for sale' or 'for rent' signs of no more than five square feet. TV/radio antennas, satellite dishes, and solar panels must be placed unobtrusively and screened from view.
