What Kingsley Crossing's governing documents say
Kingsley Crossing is a single-family home community in Garland, TX, governed by a Declaration of Covenants, Conditions, and Restrictions (CC&Rs). This document is a 1982 amendment to the original CC&Rs, modifying only two sections: maintenance enforcement (Section 3.03) and the duration & amendment process (Section 6.02). The full rulebook is the unamended Declaration.
- Maintenance enforcement & liens: If an owner fails to maintain their lot (including perimeter walls, landscaping, ground cover), the Architectural Control Committee can give written notice specifying the needed maintenance and a deadline to correct. If the owner doesn't comply, the Committee (or any owner) may do the work and charge the owner, plus interest and collection costs. That cost becomes a lien on the lot, subordinate to purchase/improvement loans but superior to most other liens (except taxes).
- Covenant term & how to change rules: The covenants run with the land for 25 years from the original Declaration date, then auto-renew for successive 10-year periods unless owners of 2/3 of lots vote to terminate. Amendments to the Declaration require a written instrument signed by owners of at least 60% of lots.
- What this document doesn't cover: This amendment only modifies two sections of the original CC&Rs. It does not contain the full set of rules for the community, such as architectural standards, land use restrictions, assessment amounts, or other typical HOA provisions. You need the original Declaration for that.
