Lake Highlands Pointe is a standard single-family home subdivision (HOA) in Garland, TX. This Declaration sets rules for lot owners, enforceable by the homeowners association. It covers residential use, architectural standards, and maintenance obligations — but does not regulate leasing or age restrictions.
- Use restrictions: All lots must be used for single-family residential purposes only. No commercial, industrial, or non-residential uses are allowed. Garage sales are permitted with prior Association consent, but no more than two per year, each lasting no more than two days.
- Architectural review: No exterior improvements (including buildings, fences, walls, signs, pools, or changes exceeding $1,000 in cost) may be constructed without prior approval of the Board. Plans and specifications must be submitted; approval is deemed given if not acted upon within 30 business days.
- Minimum square footage & exterior materials: Each residence must have at least 1,400 square feet of air-conditioned floor area (exclusive of porches, garages, patios, etc.). At least 75% of exterior surfaces (excluding roofs, windows, doors) must be brick or approved masonry. The Board may grant variances up to 10%.
- Parking & vehicles: Trucks with tonnage exceeding 3/4 ton may not be parked or stored on any lot except in a garage. Commercial vehicles of any size are prohibited. No vehicle may be parked on a lot for more than 12 hours in any 24-hour period unless inside a garage.
- Pets & animals: Only household pets (dogs, cats, or similar) in reasonable numbers are allowed. No livestock, poultry, reptiles, or exotic animals (e.g., horses, pigs, monkeys) are permitted. Pets may not be bred or maintained for commercial purposes.
- Assessments & fees: Annual assessments begin at $120 per lot, adjustable by the Board. Special assessments may be levied for capital improvements. Late payments accrue interest at up to 18% per annum, and the Association may file liens and foreclose on delinquent lots.
- Maintenance responsibilities: Owners must maintain their lots, including landscaping, and keep sidewalks in compliance with city codes. The Association maintains common areas (entrance monuments, drainage, etc.) using assessment funds.
- What this document doesn't cover: This Declaration does not address leasing or rental restrictions, age restrictions, or condominium-type shared ownership. There are no rules about short-term rentals, minimum lease terms, or resident age limits.
