Godley Meadows Phase One is a single-family residential subdivision in Godley, Texas, governed by a set of private restrictive covenants (not an HOA). These covenants run with the land and bind all lot owners, their heirs, and assigns. The rules focus on minimum dwelling size, construction standards, land use, and architectural control—there is no homeowners association or assessments.
- Minimum dwelling size & construction: Each lot may have only one single-family dwelling of at least 1,200 sq ft of living area (exclusive of garage, porches, out-buildings). Principal dwellings must be built 50–150 feet from the front property line and at least 30 feet from side lines. Roof material must be galvanized/painted steel, wood shingles, or 240 lb composition shingles in gray or green; roof pitch must be at least 7/12. Construction must be completed within 12 months. All improvements must use new materials (except standard used building materials like brick). No mobile homes, manufactured homes, trailers, or temporary structures may be used as residences.
- Property use restrictions: No tract may be used as a junk yard or for selling used cars. Unlicensed vehicles cannot remain on a tract for more than 30 days. No storage of chemicals or hazardous materials. Up to two head of cattle or horses per tract are allowed, but no hogs, chickens, sheep, emu, ratites, or livestock unless the owner maintains a permanent residence on or adjacent to the tract. No commercial dog breeding. All pets/allowed animals must be fenced. No tract may be subdivided below its original lot size.
- Setbacks & environmental: Driveway culverts must be at least 18 inches in diameter and comply with county standards. No dwelling may be built in a 100-year floodplain unless the finished floor is at least 1 foot above the floodplain elevation. Owners must not block water flow or build in drainage easements. A private sewage facility permit is required; only one residence per septic system. Owners are responsible for upgrading failing septic systems.
- Fences & out-buildings: Privacy fences are allowed at the rear or side of the house but not in front. All out-buildings must be wood or R-panels, painted or better. Barns must be at least 100 feet from a neighbor's residence. No temporary structures.
- Architectural review: An Architectural Control Committee (ACC) of two members—initially the developers—must approve all plans for main dwellings and garages before construction. If the ACC fails to act within 30 days of submission, approval is deemed given if the design harmonizes with existing structures. The ACC may grant exceptions by majority vote. The committee may be replaced by a majority of lot owners if members resign or are unable to serve.
- Duration & amendments: These restrictions run for 35 years from the date of recording (March 2001), automatically renewing for successive 10-year periods unless a majority of lot owners record a modification or release. Amendments require the written consent of 80% of lot owners (one vote per lot).
- Enforcement: Any lot owner may sue to enforce these covenants or recover damages for violations. Invalidation of one covenant does not affect the others.
