- Architectural denial & appeal process: If the HOA denies your application for home improvements, you get a written notice describing the basis and any conditions for approval. You can request a hearing with the board within 30 days of the denial notice; the board must give at least 12 days' notice of the hearing date, and either side can postpone once for up to 10 days.
- Hearing procedures: Hearings are private, but the board votes on the outcome in an open meeting with member notice. Either the owner or the association may audio-record the meeting. The board can affirm, modify, or reverse the architectural decision.
- Records inspection & production: Owners (or a designated agent) can request association records in writing via certified mail. The association must respond within 10 business days, or give a written notice with a date when the records will be available. Certain records (like payment histories, owner contact info, and employee personnel files) are excluded.
- Copy & labor fees for records: The HOA charges $0.10 per standard page, $0.50 per oversize page, $1.00 per CD, $3.00 per DVD, and $15.00 per hour of labor (no labor or overhead charge for requests of 50 or fewer pages). Overhead is 20% of labor, plus actual costs for labels, boxes, postage, etc.
- Disputes over records access: If denied access, you can sue in justice court. The court may order release of records, award court costs and attorney's fees, or authorize damages. Before suing, you must send written notice of intent at least 10 business days in advance via certified mail or with signature confirmation.
