What Saratoga Prop Owners's governing documents say
This is the First Amended Bylaws of the Saratoga Property Owners Association, a standard single-family HOA in Hackberry, TX. This document describes how the association is run — its board, meetings, finances, and enforcement powers. It is not the full rulebook; the actual use restrictions (e.g., pets, leasing, architectural standards) are in a separate Declaration of Covenants, Conditions and Restrictions that is incorporated by reference.
- Association governance & meetings: The association is governed by a 5-member Board of Directors elected by owners. Annual meetings are held in November. A quorum of at least 1/10 of all votes is needed to conduct business, and a majority of votes present decides most issues. Proxies are allowed but expire after 30 days.
- Assessments & finances: The Board sets annual and special assessments to cover common expenses. Assessments are due as determined by the Board; delinquencies can lead to suspension of voting rights and common-area access (except access to the owner's property), plus liens and lawsuits. The Board may spend up to $500 without a meeting if half the directors agree. Two officers must co-sign checks over $500.
- Architectural control: An Architectural Control officer on the Board reviews and approves structural modifications or alterations. Owners must get approval before making changes; the Board also enforces the design guidelines in the Declaration.
- Owner obligations & compliance: Owners must pay all assessments, maintain their lots, and follow the Declaration and Board rules. Violations can be abated by the association at the owner's expense, and legal action can be taken to enforce rules. Owners are responsible for damage to common areas caused by them or their tenants.
