It binds the current and future owners of that lot, as well as tenants and occupants, to specific obligations about an on-site drainage swale. If you are considering buying or living on this particular lot, you must follow these drainage-related rules in addition to any general HOA regulations.
- Drainage swale maintenance: You may not change the grade or slope of the swale, and you must not block the flow of surface water along it. You are required to promptly notify The Tribute Owners Association if you suspect the swale is damaged or malfunctioning.
- Fences & runoff: Any fence crossing the swale must have openings or be elevated so that rainfall runoff can flow under and through it without obstruction.
- Access for inspections & repairs: You must let the Association and its contractors enter the drainage easement on your property to perform inspections, maintenance, or repairs of the swale.
- Who must follow these rules: The restrictions bind not only the owner of Lot 38 but also all tenants or other occupants. The restrictions also override less restrictive zoning or building codes, and only the Declarant and the Association have the right to enforce them.
