Ouro Verde is a single-family home subdivision in Haslet, Texas (originally Arlington), governed by a homeowners association. However, these rules only apply to lots that are partially covered by the subdivision's lake system — other lots in Ouro Verde may not be bound. The document is a 1977 Declaration of Covenants and Restrictions, along with Articles of Incorporation and Bylaws for the Ouro Verde Homeowners Association, Inc.
- What this document covers: This declaration applies only to lots that are partially covered by the Ouro Verde Lake System (e.g., Lots 5-10 of Block C, and Lots 2,3,11,12,13 of Block C and 1,2 of Block D). Other lots in the subdivision are not subject to these rules.
- Membership & voting: All lot owners are automatically members. Voting rights vary: Class A members (Lots 5-10 Block C) get 2 votes per lot; Class B (developer, Phillips Construction) gets 3 votes per lot until Class A+C lots exceed 3x Class B lots; Class C members (specified lots) get 1 vote per lot. Joint owners may cast only one vote per lot.
- Assessments & fees: Annual assessments: $60 per lot for Class A, $30 per lot for Class C, due September 1. Special assessments require 2/3 membership vote. Assessments create a lien on the lot; unpaid assessments accrue 10% annual interest and reasonable attorney's fees. Mortgage liens are senior to assessment liens.
- Architectural review: No building, fence, or structure may be built without prior approval of the Lake Control Committee (appointed by the Board). Plans must be submitted for review of design, materials, and harmony with surroundings; the committee must act within 30 days or approval is deemed given.
- Lake use restrictions: No gasoline-powered boats allowed on the lake; only electric motors up to 3 HP permitted. No water may be drawn from the lake by anyone. Boats must be owned by association members. Each member has a reasonable right to use the entire lake surface, but no right to use another's lot or easement. No structure may be located closer to the lake than the utility/flowage easement shown on the recorded plat.
- Pets & animals: Only ordinary household pets are allowed. No commercial breeding, no dangerous animals. Pets must not be left loose on common elements and must not cause noise, odor, or unsanitary conditions.
- Enforcement & duration: Covenants run with the land for 30 years from recording (1977), automatically renewing for successive 10-year periods unless a majority of lot owners vote to change. Violations can be enforced by legal action or lien. Unpaid assessments or rule violations may result in foreclosure or other remedies.
- What this document doesn't cover: This document does not address leasing/rental restrictions, age restrictions, parking rules, or specific architectural standards beyond committee approval.
