- What you own & maintain: You own your lot and the residence on it. The HOA maintains common areas, easement areas, and the perimeter landscaping (shown on Exhibit A). You are responsible for maintaining your residence and roof, and must cooperate with adjoining owners on shared party walls and roofs.
- Party walls & shared structures: Most residences share a common party wall with an adjoining residence. Each owner has the right to use the wall for support, and may enter the adjacent lot (with notice) to repair it. Repair costs are split equally unless caused by one owner's negligence.
- Architectural review: All exterior changes (structures, landscaping, hardscape, tree removal) require prior written approval from the Architectural Control Committee. The committee has broad discretion over aesthetics and design compatibility. Plans not responded to within 30 days (plus a reminder) are deemed approved.
- Assessments & fees: All owners (except Declarant) must pay annual assessments, which start at $1,500 per year per lot. Annual assessments may be increased up to 20% per year without a membership vote; larger increases require a 2/3 vote. Special assessments and fines for violations are also possible.
- Construction & use restrictions: Residences must be single-family, minimum 1,600 sq ft of air-conditioned space, and have an enclosed two-car garage. Maximum height is 2.5 stories or 35 feet. Roofing and exterior materials must follow Design Guidelines. All structures must conform to setback lines and government requirements.
- Enforcement & liens: The HOA can enforce restrictions through fines (after due process), suspension of common area use, and lawsuits. Unpaid assessments and enforcement costs become a lien on the property, which can be foreclosed (except for fines-only debts). Owners waive certain rights to notice and hearing before foreclosure.
