What Enchanted Forest's governing documents say
This document is the declaration of covenants, conditions, and restrictions (CC&Rs) for the Enchanted Forest Addition, a single-family residential subdivision in Joshua, TX. It governs all lots and is binding on owners, their successors, and assigns. These restrictions run with the land for an initial 35 years (from 1964) and automatically renew for 10-year periods unless a majority of lot owners vote to modify or terminate them.
- Land use & business: All lots are designated for single-family residential use only. No apartments, motels, or businesses (including home-based businesses) are allowed. Subdivision marketing is excepted.
- Architectural review & minimum standards: No structure may be erected or altered without written approval from the Architectural Control Committee. Residences must have at least 2,500 square feet of floor space (excluding porches and garages), be at least 80% masonry (stone, brick, or brick veneer), and have a roof with a minimum pitch of 8:12 using timberline shingles (300 weight or better), wood shingles, or tile. Composition shingles other than timberline are not permitted. Two‑story dwellings must have at least 1,600 square feet on the ground floor. The committee may waive roof or exterior wall requirements if the home's appraised value is at least $150,000.
- Fences: Front‑yard fences must be split rail, brick, or wrought iron. Rear and side fences may be masonry (not cement block), stockade, split or running rail, wrought iron, brick, painted pipe, or painted pipe and cable, and cannot exceed 6 feet in height. Lots bordering the 25‑acre subdivision perimeter may have taller fences along that edge with committee approval. Chain‑link fencing is allowed only inside a completely private area (e.g., around a pool or dog enclosure).
- Setbacks & easements: No building may be located within 30 feet of any street. Utility and drainage easements are reserved as shown on the recorded plat.
- Pets & livestock: No animals, livestock, or poultry may be bred or kept for commercial purposes. Horses are allowed: 3 per 2.5‑acre tract or 4 per 3‑acre tract. Dogs, cats, and other household pets are permitted provided they are confined. Excessive animals are considered a nuisance. If a horse is kept, it must be enclosed by a painted pipe, painted pipe and cable, or masonry fence.
- Vehicles & parking: No inoperable vehicle may remain on a lot for more than 10 days. No vehicle larger than a 3/4‑ton pickup truck, disabled vehicle, motor home, travel trailer, utility trailer, or travel‑all may be parked on the street or in the front two‑thirds of the lot; they must be placed on the back one‑third of the property. Campers, boats, or similar vehicles may not be advertised for sale on the lot. No parking on the front or side street.
- Garbage & trash: Trash and garbage must be kept in sanitary containers. Incinerators must be masonry. Garbage cans may remain on the property for a maximum of 24 hours on pickup day. No lot may be used as a dumping ground.
- Signs: No signs, billboards, or advertising structures are permitted except a single rental or sale sign not exceeding 3 feet by 5 feet. Subdivision development signs are excepted.
