What Kings Fort Kaufman II's governing documents say
This is a mutual access, parking, and signage easement declaration for commercial lots in Kings Fort Kaufman Phase II (Kaufman, TX). It binds the lot owners (and their tenants/occupants) to shared easements and maintenance obligations for driveways, parking, and a common monument sign. It does not form a homeowners association nor impose residential-style rules.
- Easements granted: Each lot grants reciprocal easements for access, ingress/egress (but not parking) over paved driveways and walkways, and for parking on designated areas. A separate easement allows use of the Shared Monument Sign, with each lot getting one or three panels as per the replat. A dumpster easement is also granted.
- Maintenance of common areas: Each owner must maintain the common area on their lot (driveways, parking areas, sidewalks) in good repair, including cleaning, striping, and signage. They must also maintain landscaping, drainage, and open spaces. The owner of the lot with the Shared Monument Sign handles its maintenance, and each lot pays one-quarter of the common costs.
- Parking compliance: No lot may be used in a way that causes the lots collectively to fail to meet government parking ratio requirements.
- Signage & alterations: Each lot may make nonstructural alterations to its assigned sign panel. No alterations, modifications, or blocking of easement areas (drives, roads) are allowed without written consent of all other lot owners and compliance with the declaration.
- Enforcement & self-help: If an owner breaches the declaration, other owners may seek injunctive relief, specific performance, or damages. After notice and failure to cure within 30 days (or immediately for parking violations), an owner may enter the defaulting owner's lot to perform necessary maintenance and seek reimbursement.
- What this document doesn't cover: This declaration does not cover typical residential HOA rules such as pet limits, lease restrictions, age restrictions, or architectural review for buildings. It is limited to mutual easements, maintenance, and signage among commercial lot owners.
