Berry Hill Estates is a single-family home subdivision in Tarrant and Johnson Counties, Texas, governed by restrictive covenants recorded in 1997. These covenants bind all lot owners and are enforceable by any property owner. The rules control lot use, construction, maintenance, animals, vehicles, and more.
- Lot use & dwellings: Each lot is limited to one single-family detached dwelling. Minimum living area is 2,100 square feet (excluding porches); one-story or split-level homes must have at least 1,500 square feet on the ground floor. No manufactured or prefabricated homes allowed. Maximum dwelling height is 35 feet.
- Architectural review: All construction plans must be approved in writing by a two-member Architectural Control Committee before building. The committee can waive restrictions for hardship or topography. If no response within 30 days, approval is not required, but failure to approve does not waive the restrictions.
- Building & exterior standards: Exterior walls must be masonry (first and second floors). Roofs must be fire-resistant (shingle, composition, copper, slate, standing seam metal, or tile) with a minimum 7/12 pitch. Sheet metal (except flashing) is prohibited. Each home must have a minimum two-car garage, and garage entrances cannot face the front street. Driveways must have an all-weather surface.
- Animals & livestock: No swine allowed. Up to two cattle or horses per tract are permitted, and they must be kept in a fenced yard. Each lot may have a maximum of three dogs, which must be leashed or fenced. Dogs must be vaccinated for rabies. Commercial breeding is prohibited.
- Parking & vehicles: No junk, inoperable, or unlicensed vehicles allowed unless stored in a garage. Vehicles over 1 ton, construction equipment, and semi-trailers cannot be stored overnight on lots except for construction. No boats, jet skis, aircraft, travel trailers, motor homes, or campers may be parked in front of any dwelling or on streets. Motorcycles and dirt bikes must have baffled mufflers.
- Maintenance & nuisances: Grass and weeds must be mowed (average height ≤6 inches in front/yard areas, ≤15 inches in unimproved pasture). Trash must be in covered containers and removed regularly. No dumping on lots. The committee can cut vegetation at owner's expense and place a lien for unpaid costs. Businesses causing annoyance, noise, odors, or unsightly conditions are prohibited.
- Signs & structures: No signs except one 2x3 foot sign advertising sale or rental. Servants' quarters may be built with committee approval. Fences in front must be steel bar/pipe, wood, or PVC; no chain link or barbed wire. Privacy fences (wood, PVC, or masonry) only around pools/patios.
- Wastewater: All residences must use an aerobic treatment unit for wastewater (no septic tanks with absorption trenches). Disposal areas must be at least 30 feet from property lines and 50 feet from ditches/creeks. Owners must maintain the system and upgrade if it causes odors or unsanitary conditions.
