Blair Ranch is a rural subdivision of large lots (tracts) in Johnson County, Texas. This document is a temporary Declaration of Water Rights, not a full homeowners' association rulebook. It creates short-term (60-day) shared access to existing water wells, ponds, and lines among the tracts, along with equal cost-sharing for maintenance, until a permanent agreement is made or public water arrives. It binds all current and future tract owners.
- Shared water access: Each tract gets equal right to use water from any existing source (well, pond, lake) on another tract, via current water lines, for 60 days after the document's recording.
- Cost sharing: All owners must share equally (by number of tracts) the costs of maintaining, repairing, or improving the water supply system, even if a particular tract doesn't benefit from a specific source.
- Temporary duration: The declaration automatically expires 60 days after its recording date (November 4, 1999), unless owners reach a permanent water-sharing agreement or public water is installed.
- Easements for water lines: Each tract is burdened with an easement for existing water lines crossing it, with access rights for the benefiting owners to repair those lines. The benefiting owner must indemnify the servient tract for any damage.
- What this document doesn't cover: It does not create any permanent water rights, a homeowners' association, rules for buildings, pets, leasing, or other typical subdivision covenants. After 60 days, an owner may have no right to water from neighboring tracts unless they negotiate a new agreement.
