This document is a set of restrictive covenants for Elm Mott Creek, a residential subdivision in Keene, Texas. The covenants run with the land and bind all current and future owners. No homeowners association is created; enforcement is by the declarants or any lot owner.
- Minimum lot size & house size: No lot may be subdivided to less than 10 acres with at least 150 feet of public road frontage. Any dwelling must be at least 1,500 square feet of living area, excluding garage, porches, and outbuildings.
- Architectural approval & setbacks: All new construction or exterior changes require written approval from a 4-member Architectural Control Committee. Setbacks: at least 50 feet from front property line, 100 feet from the rear, and side setbacks specified elsewhere in the document.
- Prohibited structures & uses: No used residences, mobile homes, house trailers, manufactured homes, modular homes, campers, tents, shacks, or temporary structures may be used as a residence. No business, commercial, or manufacturing uses are allowed.
- Sewage & floodplain: A private sewage facility permit is required for each tract. Owners must maintain the system and may need to upgrade if it causes odors or unsanitary conditions. No dwellings (except existing ones) may be built in the 100-year floodplain unless the finished floor is at least 1 foot above the flood elevation.
- Vehicle & junk storage: No tract may be used as a junk yard or for storing used cars. Unlicensed vehicles may not remain on the property for more than 60 days. No chemical storage or dump sites are allowed.
- Animal restrictions: Hog farms and poultry operations are prohibited on any portion of the property.
- Duration & enforcement: These restrictions run for 35 years from January 2002, with automatic 10-year extensions unless a majority of tract owners vote to modify or release them. Violations may be enforced by any declarant or lot owner through legal action.
- What this document doesn't cover: This is a set of restrictive covenants and does not create a homeowners association. There are no provisions for assessments, common areas, leasing restrictions, pet limits, or architectural committee rules beyond initial approval.
