What Mustang Hill's governing documents say
Mustang Hill is a single-family residential subdivision in Johnson County, Texas, with covenants that run with the land until July 31, 2012, automatically renewing every ten years. The covenants apply to all lot owners and cover building standards, land use, and architectural control. There is no homeowners' association mentioned; enforcement is by any owner or the developer.
- What you can build: Only one detached single-family dwelling per lot, plus a private garage and suitable outbuildings. The ground floor area must be at least 2,000 square feet (1,400 for two-story homes), exclusive of porches and garages. At least 75% of exterior walls must be stone or masonry. All construction must be completed within 12 months of starting foundation.
- Setbacks & location: No building shall be located closer than 50 feet to the front lot line. Walls or hedges that obstruct view are not allowed forward of the front setback line, nor nearer than 5 feet to any side lot line. Detached garages and outbuildings must be of good quality materials and neatly maintained.
- Prohibited uses & activities: No oil drilling, mining, or quarrying. No retail trade or business, but home occupations are allowed with no retail, no stock in trade, and no on-site advertising. No junked or unlicensed vehicles visible from the road. No motorcycles unless equipped with baffled muffler. No mobile homes, trailers, tents, shacks, or temporary structures used as residences.
- Animals & livestock: No commercial breeding of animals or fowl. No swine. Maximum of two breeding-age domestic horses, cattle, llamas, emus, or other large livestock per acre.
- Architectural control: All construction plans, specifications, and site plans must be approved by the Architectural Control Committee, headed by Larry D. Sanford (or Pamela J. Sanford as successor). The Committee can waive restrictions and receives no compensation.
- Duration & amendments: Covenants are in effect until July 31, 2012, then automatically extend for successive 10-year periods. Until 2012, the developer can amend or revoke covenants without owner consent. After that, a majority of lot owners (by acreage) can change them.
