Nolan Ranch is a single-family subdivision in Keene, TX, governed by a homeowners association (HOA). Each lot owner owns the land and home and must comply with use restrictions, building standards, and maintenance obligations. The HOA maintains common areas (roads and drainage) funded by annual assessments.
- Use restrictions: Residential lots may only have one detached single-family dwelling or manufactured home, maximum two stories, minimum 800 sq ft of living area. No temporary structures (buses, tents, travel trailers) may be used as a residence, except that during active construction a travel trailer, camper, RV, or tiny home (≤400 sq ft) is allowed for up to 6 months, after which it must be removed or repurposed for storage/incidental use only.
- Building & construction: All homes must be masonry or frame construction. Pre-owned site-built homes require declarant approval. Manufactured homes must be no more than 6 years old (from manufacture date) and must be skirted within 30 days of installation. Driveways, parking areas, and sidewalks must use new materials (no debris or salvaged materials).
- Pets & animals: No farm animals, livestock, or poultry except that backyard poultry is allowed: maximum 12 hens per lot (no roosters), coop must be in rear yard ≤100 sq ft, kept clean and nuisance-free. A reasonable number of dogs, cats, or other household pets are allowed, but not for commercial purposes; must be behind a fence or on leash.
- Assessments & fees: Annual regular assessment initially $400 per lot, payable yearly in advance by January 1. Board may change the amount with 30 days' written notice. Special assessments may be levied for common area improvements (roads, drainage) with board approval; other specials require 2/3 member vote. Assessments are a personal obligation and secured by a lien on the lot.
- Maintenance obligations: Owners must keep buildings, fences, landscaping, and other improvements in neat and orderly condition. Failure to maintain after 30 days' written notice allows declarant or other owner to enter and perform work, with costs becoming a lien on the lot. Weeds and grass must be mowed regularly.
- Common area & easements: Common areas (roads, drainage infrastructure) are owned by the association. Owners have an easement to use common areas but may not erect structures or disturb them without board approval. Easements for utilities and drainage are reserved; no obstructions allowed.
- Enforcement & fines: Declarant may fine owners for specified violations: $500/month for using temporary structures as residences or for placing manufactured homes older than 6 years; $100/month for missing skirting; $250/month for other Article 4 violations. Fines require written violation notice with opportunity to cure and a hearing. The right to fine expires when declarant no longer owns any lot or lien in the subdivision.
