What Savage Addition's governing documents say
This is a recorded set of deed restrictions for the Savage Addition subdivision in Keene, TX. It applies to all lot owners and focuses on storm drainage, floodplain construction, driveway culvert requirements, and private sewage facilities. These restrictions are enforceable by the county and do not create a homeowners association.
- Drainage & floodplain: Houses in a 100-year floodplain must have a finished floor at least 3 feet above the floodplain elevation. No buildings, dirt, rocks, or other materials may be placed in the floodway. Blocking flow of water or constructing improvements in drainage easements is prohibited. Existing creeks or drainage channels must remain open and be maintained by adjacent lot owners.
- Driveway & culverts: Driveway culverts must be at least 18 inches in diameter unless approved by the county commissioner or engineer. They must be sized to pass the 5-year storm flow. The top of the driveway above the culvert must be 5 inches below the outside edge of the main road to allow overflow to pass.
- Private sewage facilities: If on-site sewage is used, the lot owner is responsible for maintaining and operating the system. The county does not guarantee performance and may require upgrades if odors or unsanitary conditions occur. The facility must comply with all county, state, and federal regulations.
- County liability & enforcement: Johnson County is not responsible for maintenance of drainage ways, erosion control, or damage from flooding. The county has the right (but not duty) to enter property and clear obstructions from drainage easements. Any racial restriction on sale or rental is invalid under federal law.
- What this document doesn't cover: These deed restrictions do not address architectural controls beyond drainage, pet limits, leasing restrictions, parking, or any association fees. There is no homeowners association; restrictions are enforced through the county and property deeds.
