Silvermark Estates is a single-family home subdivision in Keene (Johnson County), TX. It's governed by a standard homeowners' association (HOA) that enforces uniform design, maintenance, and land-use rules. This declaration binds all lot owners, occupants, and future buyers.
- Permitted use & building type: Only single-family detached dwellings are allowed — no duplexes, townhouses, apartments, mobile homes, or temporary structures. Each lot can have one main residence plus a garage, barn, or outbuilding (with ACC approval). No group homes, daycares, or similar facilities.
- Construction & design standards: Homes must be at least 1,800 sq ft (excluding porches and garages), have a minimum 75% rock or brick veneer exterior, and a roof pitch of at least 12/12. Composition roofs must weigh ≥240 lbs per 100 sq ft. Metal or tile roofs are acceptable. Front setback: 40 ft, rear: 20 ft, side: 5 ft. All construction must be completed within one year of slab pour.
- Architectural review (ACC): Any exterior change (new structure, alteration, fence, landscaping) requires prior written approval from the Architectural Control Committee. Plans are deemed complete after 30 days unless more info is requested; if the ACC does not disapprove within 60 days of a complete submission, the plans are deemed disapproved (so explicit approval is needed). Owner may appeal an ACC decision to the Board.
- Assessments & fees: Annual regular assessment starts at $200 per lot (may be changed by Board). Special assessments require a two-thirds membership vote. Delinquent assessments incur a 5% late charge and 18% annual interest, plus the Association's attorney fees. The Association has a lien on the lot for unpaid assessments.
- Pets & animals: Up to three common household pets (dogs or cats) are allowed per lot. Pets must be confined to a fenced yard or within the lot. No commercial breeding, kennels, livestock (including swine, horses, or poultry) are permitted. Game fowl and animal feedlots are also prohibited.
- Parking & vehicles: Only operable vehicles may be parked on the lot, and must be in designated parking areas or within a structure. Junk, broken vehicles, and unsightly objects must be shielded from view. No recreational vehicles, trailers, or boats may be stored outside unless visible from the street? (text unclear).
- Fencing: All fences must be pipe fences (metal) as shown in sample photos, unless a variance is obtained from the developer. Fence location and materials are subject to ACC approval.
- Developer control period: Until the developer sells all lots, the developer (Declarant) appoints the Board and ACC members, has 10 votes per owned lot, and can unilaterally amend the declaration. After development period, amendments require 60% membership vote.
