This is a collection of three separate deed restriction documents affecting specific residential parcels in the Keene/Burleson area of Johnson County, Texas. They are not a full set of community rules, but rather individual affordability covenants tied to subsidies and a commercial use amendment for neighboring properties. The restrictions bind only the owners of the identified lots and do not create a homeowners association or common property.
- Affordability & subsidy repayment (DOC 57406): A five-year retention period applies during which the owner must repay a pro-rata share of a Direct Subsidy from the Federal Home Loan Bank of Dallas on any sale or refinancing, unless the buyer is a low- or moderate-income household (income at or below 80% of area median). The repayment amount is reduced by 1/60 per month of ownership. The restriction runs with the land.
- Affordability & subsidy repayment (DOC 57407): A five-year Repayment Period applies for a $5,000 Direct Subsidy from Fort Worth Area Habitat for Humanity. On sale or refinancing, owner must repay a prorated amount ($83.33 per month remaining) from any net gain, but no repayment is required if the buyer is a low- or moderate-income household. The restriction is subordinate to prior liens and may be revived after foreclosure in certain circumstances.
- Commercial exclusive use restrictions (DOC 57408): An amendment to a Declaration of Covenants, Restrictions, and Reciprocal Easements imposes reciprocal exclusivity: as long as the Starbucks lease is in effect, the Trust Parcel cannot violate the Starbucks Restriction (limiting sale of coffee/espresso drinks); as long as the Taco Bueno lease is in effect, the Westover Parcel cannot violate the Taco Bueno Restriction (limiting sale of Mexican food within 1000 feet). These restrictions only apply to the two commercial lots and do not affect residential properties.
