This is a deed restriction for the Tabletop Ranch Addition in Keene, TX (Johnson County), covering Lots 1-29, Block 1. It binds lot owners to specific construction and drainage rules tied to county subdivision regulations, but does not create a homeowners' association or common property.
- Building & floor elevation: Houses must have a finished floor elevation at least 18 inches above the uphill side's natural grade to prevent stormwater damage. Houses in the 100-year floodplain must have a finished floor at least 3 feet above the floodplain elevation shown on the plat.
- Driveway culverts: Driveway culverts must be at least 18 inches in diameter unless approved otherwise, sized to pass a 5-year storm flow. The top of the driveway must be 5 inches below the outside edge of the main road to allow overflow to pass.
- Floodplain & floodway restrictions: No buildings, structures, dirt, rocks, or other materials may be placed in the floodway. Filling or obstructing the floodway is prohibited. Building in the 100-year floodplain is allowed only if the finished floor is at least 3 feet above the floodplain elevation.
- Drainage easements & channel maintenance: Lot owners must not block flow or construct improvements in drainage easements. Existing creeks or drainage channels on or adjacent to a lot must be maintained as open channels by the individual lot owner. Johnson County is not responsible for maintenance, damage, or injury from flooding.
- Private on-site sewage facilities (septic): Lots served by private sewage facilities must comply with Johnson County and TCEQ regulations. The county does not guarantee performance, and the owner must upgrade the system at their own expense if it causes odors, unsanitary conditions, or violates regulations, even if initially approved.
- What this document doesn't cover: This deed restriction does not create an HOA, impose assessments, restrict leasing or pets, or regulate architectural aesthetics beyond the elevation and drainage rules. It does not establish any common amenities or shared maintenance obligations beyond drainage channels.
