This is the governing rulebook for Fort Worth Stone Creek Ranch Homeowners’ Association, Inc., a standard single-family home community (not condos or attached homes) near Fort Worth, TX. It explains what you as an owner must follow—what you own, what the HOA maintains, what you can build, and what fees you owe—and applies to all owners, residents, and their guests.
- What you own & maintain: You own your Lot and the single-family home on it. The Association maintains the 'Areas of Common Responsibility' — mostly entry features, perimeter walls/fencing, landscaping and irrigation for those common areas, and the public park site (Lot 12X, Block 23) that Declarant agreed with the City to maintain. The Association may also maintain any Common Area it owns.
- HOA assessments & fees: The initial regular assessment can’t exceed $250 per year per Lot. Each year the Board may increase it up to 20% over the prior year; any higher increase requires a 66⅔% vote of Members. A $150 Acquisition Fee and (optionally) up to a $500 Capital Improvement Reserve Fee are charged to each new buyer at sale. The Association may also levy Special Assessments (needing 66⅔% approval) and individual special assessments for specific Lots. Assessments are due on dates set by the Board; they become delinquent 30 days after the due date, accrue 18% interest, and may include a $100/month late fee.
- Architectural review: An Architectural Control Committee (3 members, initially appointed by Declarant) must approve all plans for new construction or any exterior alteration (home, fence, wall, driveway, pool, landscaping, exterior colors, etc.) before work begins. Submit plans at least 30 days in advance; if the Committee doesn’t respond within 30 days, plans are deemed approved. The Committee can grant reasonable deviations from the specific rules, but such approval must be in writing. The Board can review and overrule Committee decisions.
- Construction & design standards: No structure, fence, wall, pool, driveway, landscaping, or other improvement may be built or altered without prior Committee approval. The Committee uses commercially reasonable efforts to ensure aesthetic harmony. Builders may reuse approved plans without separate approval unless there are major material changes. Owners must remove unapproved improvements at their own expense.
- Voting & membership: There are two classes: Class 'A' (all Owners except Declarant, one vote per Lot) and Class 'B' (Declarant, ten votes per Lot while it owns Lots and the Class B period lasts). Class B ends when the total Class A votes equal Class B votes, ten years from recording, or when Declarant decides. No cumulative voting. A Member must be current on assessments and have no current violations to vote or hold office. A quorum for Member meetings is 25% of all entitled votes.
- Enforcement & fines: The Board may impose reasonable fines (which become a lien on the Lot) and suspend voting or common-area use for violations. Before a fine, the Board must give a written notice describing the violation, proposed sanction, and a 30‑day period to request a hearing. After a hearing, the owner may appeal to the Board within 30 days. The Association may also use self-help (e.g., towing vehicles in violation of parking rules) or sue.
- Parking & vehicles: The Association may tow vehicles that violate parking rules. 'Vehicle' is defined broadly to include cars, trucks, SUVs, motorcycles, boats, jet skis, mobile homes, motor homes, aircraft, boat trailers, and any other trailer.
