Ladera Reserve is a condominium community in Mansfield, TX (Tarrant and Johnson counties) — you own your unit (which includes the building exterior, roof, windows, etc.) and share ownership of common elements. This is a third amendment to the condominium declaration, not the full rulebook. It clarifies who is responsible for maintaining what, adds landscaping services, and restricts the association's ability to sue on behalf of owners. The full declaration and other amendments still apply.
- What you own & maintain: Your unit includes everything within the exterior walls, concrete slab, roof, windows, doors, and all fixtures and systems serving only your unit (e.g., HVAC, water heater, appliances). You must maintain your unit and any limited common elements serving it, including exterior paint, glass, light fixtures, and any non-standard upgrades (e.g., covered patios, pergolas, firepits). The association maintains the roof (except major repairs you pay for), exterior masonry/siding, gutters, downspouts, balconies, patios, porches, shutters, and dormers.
- Landscaping & irrigation: The association provides landscape services for front yard areas (as defined in the rules and regulations) and maintains a central irrigation system. The association is not obligated to provide landscaping to rear and side yards. Owners may perform their own landscaping only with prior written board approval.
- Exterior maintenance responsibilities: You are responsible for all exterior maintenance not specifically assigned to the association, including window glass, sliding glass doors, garage doors, doorknobs, and other hardware. If your maintenance falls below the community standard, the board can give 10 days' notice and, with a 2/3 vote, enter your unit to do the work at your cost.
- Association powers & restrictions: The association cannot sue on behalf of an individual owner or bring construction-defect claims for units. This restriction requires 100% owner approval to change. The declaration can be amended by 67% of voting members; the board or declarant can amend without owner vote to meet Fannie Mae, Freddie Mac, FHA, or VA requirements.
- Dispute resolution: Any disputes subject to arbitration: each party pays its own costs and shares arbitrator fees equally. The arbitrator cannot award attorney's fees or costs to either party.
- What this document doesn't cover: This amendment does not address leasing restrictions, pet limits, age requirements, parking rules, assessments amounts, or architectural guidelines. Those may be in the full declaration or other governing documents.
- Unit boundaries & disclaimers: The amendment redefines 'Unit' to include all interior and exterior structural elements, finishes, fixtures, and utilities serving only that unit. Square footage shown on plats is approximate and not warranted by the declarant; buyers should inspect before purchase.
