What Sunset Crossing's governing documents say
This is a Restrictive Covenant and Confirmation of Dispute Resolution Agreement for Lot 5R1, Block 6 in Sunset Crossing, Mansfield, TX. It is not a full community rulebook; it is a buyer-seller contract addendum that binds the current and future owners of this specific lot. The document focuses on mandatory mediation/arbitration for disputes, waiver of implied warranties, and limitations on lawsuits against the builder.
- Dispute resolution (mediation/arbitration): Any dispute between owner and builder relating to the property or improvements must first be mediated and, if unresolved, submitted to binding arbitration under the Federal Arbitration Act. The right to a jury trial is waived.
- Warranty waiver & limited warranty: All implied warranties (including good and workmanlike construction) are disclaimed by builder and waived by owner. The exclusive warranty is the StrucSure Home Warranty (or similar), which sets the only standards for construction.
- Time limit for lawsuits: Any lawsuit regarding the property must be filed within 2 years and 1 day after the cause of action accrues (deemed no later than the closing date). Claims beyond that period are waived.
- Repurchase option for major defects: If owner discovers a construction defect within 6 years after closing that exceeds 1% of the then fair market value of the improvements, builder may elect to repurchase the property (including closing costs and permanent improvements) within a specified process.
- What this document doesn't cover: This document does not address typical HOA rules such as pet limits, leasing restrictions, architectural review, parking, or common area maintenance. It only governs the legal relationship between the original buyer and builder for this specific lot.
