What Bower Ranch's governing documents say
This is a limited restrictive covenant (Memorandum of Agreement) for a single lot in Bower Ranch Phase 1, between the builder (Grand Homes) and the original purchasers. It does not contain the full community rules for Bower Ranch. Instead, it records key terms from the New Home Construction Agreement, including obligations to follow a separate Homeowner's Guidebook. This document binds only this lot and runs with the land.
- Dispute resolution: All disputes relating to the property and home must go to mediation and binding arbitration. The purchaser waives all rights to a jury trial.
- Warranties: No express or implied warranties are provided except the express limited warranty from Bonded Builders Warranty Group. Other warranties are disclaimed.
- Homeowner obligations: The purchaser must comply with all homeowner obligations contained in Grand Homes' Homeowner's Guidebook, which is a separate document not included here.
- Seller's repurchase right: The seller has a right to repurchase the property under Texas Property Code §27.0042, as specified in the Agreement.
- What this document doesn't cover: This memorandum does not contain the full Bower Ranch homeowners association rules, restrictions, assessments, or any other community-wide covenants. Those would need to be found in a separate Declaration of Covenants, Conditions, and Restrictions for the subdivision.
