This is an Assessment Collection Policy for the Cambridge Addition homeowners association in Texas. It is an ancillary document that details the financial and legal procedures for collecting unpaid assessments from homeowners. It does not contain the full community rules or restrictions.
- Assessment due dates & delinquency: Annual assessments are due on the first calendar day of the month they are charged. Any unpaid assessment after that date is delinquent, and stays delinquent until paid in full including all late fees, interest, and collection costs.
- Late fees & interest: If full payment is not received by the late date (grace period end), the association may charge a late fee per month and interest at the highest rate allowed by Texas usury laws, from the due date until paid.
- Payment plans: Delinquent owners must be offered a payment plan of at least 3 months and up to 18 months. The association sets the actual term and may charge reasonable administrative costs and interest.
- Application of payments: Payments received after delinquency notice are applied in a fixed order: oldest delinquent assessments first, then current assessments, then attorney fees and costs, then fines, then any other amount. Partial or conditioned payments may be refused.
- Collection procedures: The association will send delinquency notices, report to credit bureaus, order title searches, file assessment liens, and refer accounts to an attorney. It can also suspend use of common area amenities for owners delinquent 30+ days.
- Owner liability for collection costs: The defaulting owner must pay all costs of collection, including title reports, certified mail, court costs, and attorney fees incurred by the association.
- What this document doesn't cover: This is only a collection policy. It does not address property use restrictions, architectural guidelines, pet rules, leasing limits, or any other typical HOA covenants. Those would be in the main Declaration of Covenants, Conditions, and Restrictions.
