- Annexation of new property: The annexation adds Cambridge Phase 2A (lots) and certain common areas (C-1 and J-1) to the HOA, making them subject to the existing Declaration. This means those properties are now part of the association and subject to its rules and assessments.
- Enforcement process: The HOA has a formal process for violations: it sends a notice describing the violation and proposed fine, gives the owner a chance to cure (unless the violation is uncurable, like a health/safety threat), and holds a hearing if the owner requests one within 30 days. Owners can appeal the hearing decision to the Board within 10 days.
- Fines and costs: Fines are set by the Board based on the violation's nature and severity. The HOA can also charge the owner for attorney's fees and costs incurred in enforcement, which become a personal obligation and a lien on the property. Fines are in addition to other remedies.
- Repeat violations: If an owner has a similar violation within six months and was given a chance to cure, the HOA can impose sanctions without a new notice of violation, other than the fine notice.
- New owners: If a property is sold during enforcement, the new owner becomes personally liable for fines and costs resulting from their failure to correct the violation after taking ownership.
