What Legends of Mc Kinney Homeowners's governing documents say
This is an amendment to the dedicatory instruments for the Legends of McKinney Homeowners Association, a planned single-family home community in McKinney, TX. It contains the association's Amended Covenant Enforcement and Fining Policy, which establishes procedures for fining homeowners who violate the community's governing documents and includes a schedule of fines for common violations.
- Fining process & hearings: Homeowners receive a notice of violation with a deadline to cure. For curable violations, no fine is imposed if corrected within the deadline. Uncurable violations may be fined immediately. Homeowners have the right to request a hearing within 30 days; the board must hold the hearing within 30 days of the request. The homeowner is entitled to copies of documents and photos the association intends to use at least 10 days before the hearing.
- Schedule of fines: Violations are fined per occurrence plus daily fines until compliance: $25 + $20/day for unapproved buildings or alterations (Article V); $50 + $10/day for using a lot for non-single-family purposes (Article VII); $100 + $10/day for vehicle restrictions (boats, RVs, commercial vehicles, abandoned vehicles, Article 9.5); $100 + $10/day for holiday decorations left too long (Article 9.31); and $100 + $10/day for any other governing document violation not specifically listed.
- Common prohibited actions: Key rules referenced: no building or alteration without architectural (ACC) approval; all lots must be used as single-family residences; no boats, RVs, travel trailers, motor homes, golf carts, commercial vehicles, or inoperable vehicles may be kept; holiday decorations must be removed within 30 days after the holiday (Christmas decorations allowed from Nov 1 onward).
- Liability after transfer of ownership: If a homeowner transfers title during enforcement proceedings, the original owner remains liable for costs and fines incurred up to that point. The new owner is liable for any ongoing violations after transfer if they fail to correct them.
- What this document doesn't cover: This document is only the fining enforcement policy and a schedule of fines. It does not include the full Declaration of Covenants, Conditions, and Restrictions (CC&Rs), architectural guidelines, or other community rules. For complete rules, refer to the recorded CC&Rs and any other supplemental documents.
