What Muirfield Point Village Homeowners Association, Inc.'s governing documents say
Muirfield Point Village is a homeowners' association (HOA) in a master-planned community (Stonebridge Ranch) in McKinney, TX. These documents are partial: the first is a management certificate; the second is an amendment recording a 'First Amended Assessment Collection Policy'. The policy details how the HOA collects quarterly assessments from lot owners, including due dates, late fees, and collection procedures.
- Assessment due dates: Base assessments are due the first day of each quarter (January 1, April 1, July 1, October 1). Special or specific assessments have due dates set by the Board, at least 30 days after invoicing. Assessments not paid within 30 days of the due date become delinquent.
- Late fees & charges: A $25.00 late charge is assessed on any delinquent assessment. Late charges become part of the assessment and may be changed by the Board without owner approval. Additional handling fees and interest may also apply.
- Collection procedures: After a 30-day delinquency, the Association sends a reminder notice, then a default letter via certified mail. If unpaid after 45 days from the default letter, the account may be referred to legal counsel. A demand letter is sent, offering 35 days to dispute the debt. Thereafter, a notice of lien may be recorded (no sooner than 90 days after the default letter), and foreclosure may follow.
- Lien & foreclosure: A notice of lien may be recorded after the 90th day from the default letter. The Association may pursue expedited foreclosure (per Texas Rule of Civil Procedure 736) or judicial foreclosure, including a 61-day notice to lienholders. The Association can bid on the lot at foreclosure sale and may also sue for a money judgment.
- What this document doesn't cover: This document is only the assessment collection policy. It does not include the full declaration of covenants, restrictions on use (e.g., rentals, pets, architecture), or other typical HOA rules. Those would be in other recorded documents.
