What Reserve at South Ridge Homeowners's governing documents say
Reserve at Southridge is a single-family home HOA in Parker, TX. These governing documents (Bylaws and an Amendment to the Declaration) outline the rules for lot owners and residents. Key rules cover board governance, enforcement, parking, construction deadlines, and landscaping standards.
- Board structure & elections: The board has 4 directors serving 2-year terms. Initial highest vote-getters serve 1-year terms. Directors must be owners or spouses. No one with assessments delinquent >30 days or unresolved violations may be elected. A director may be removed by members or by the board for limited reasons (e.g., delinquency >90 days, missing 3+ meetings in 12 months).
- Meeting rules: Board meetings require a majority quorum. Meetings are open to members but recording is prohibited without board consent. Members cannot participate in discussions unless authorized. Association meetings require at least 10 days' notice; special meetings can be called by board or petition of 15% of lot owners. Proxies are allowed but cannot break a tie unless specifically authorized.
- Enforcement & fines: The board can impose reasonable fines after notice and a hearing. Fines must be reasonable relative to the violation's nature, frequency, and effects. The board may also abate violations at the owner's expense and suspend common area use. Actions requiring notice and hearing include fines, abatement, suspension of common areas, and filing suit (except for assessment collection).
- Parking & vehicles: Boats, RVs, campers, and similar vehicles can be parked in driveways only if not visible from the front street. They are prohibited in front yards or on public streets. Temporary construction vehicles are exempt. Parking in side or rear yards requires architectural committee approval. No vehicle may be used as a residence or office.
- Construction & landscaping: Residences must be completed within 1 year of building permit issuance. Landscaping required: front yard and first 20' of rear yard seeded/sodded, at least 1 tree per 50' of road frontage, at least 1 row of bushes along the front. No railroad ties allowed. Driveways must be concrete, brick, pavers, or approved equivalent.
- Sale notification: An owner selling a lot must notify the board at least 10 business days before closing, providing the lot address, buyer info, title company/attorney info, real estate agent names, and closing date. This can be satisfied by providing a copy of the accepted contract when requesting a resale certificate.
- Assessments: Annual assessments are due and payable in advance on January 1 each year. Unpaid assessments accrue interest. The board sets assessment amounts. Replatting multiple lots into one does not reduce the number of assessments owed; owners still pay per original lot count.
- What this document doesn't cover: These documents are incomplete and OCR'd. They do not cover pet limits, leasing restrictions, age restrictions, or specific architectural guidelines. The Declaration itself is not fully included, so some rules may be missing.
