What Graham Square's governing documents say
Graham Square is a single-family home subdivision in Pantego, Texas, governed by restrictive covenants that apply to all lot owners. These rules define what you can build, how you maintain your property, and what activities are allowed. The community was originally planned with attached homes (party walls), but any prior condominium regime has been terminated.
- Lot usage & restrictions: Lots are for single-family residential use only. No business, commercial activity, or nuisance is allowed. No livestock, poultry, or animals other than ordinary household pets. No temporary dwellings (including trailers) may be placed on a lot until construction begins.
- Building & architecture: New homes must have at least 1,100 square feet of living area (one-story, split-level, or two-story homes must have at least 600 square feet on the ground floor). At least 50% of exterior walls (excluding windows, doors, and party walls) must be brick, stone veneer, or masonry. Maximum height is two stories. Sidewalks (4 feet wide) must be installed along streets. Setback lines per the recorded plat apply.
- Architectural review: All new construction, alterations, or additions require written approval from the Architectural Control Committee. Plans must be submitted showing location, design, materials, and harmony with existing structures. The committee may waive restrictions if the house appraises for at least $21,000.
- Party walls & fences: Party walls (walls on lot boundaries) are governed by general rules of law. Any free-standing wall on a common property line must be 6 feet high, masonry, with no protrusions. Fences and walls may be masonry or substantial wood and can extend to the property line. Construction of a common wall requires written agreement of both lot owners.
- Maintenance & appearance: Grass and weeds must be mowed regularly. Exterior siding and wood trim (except cedar roofs) must be stained or painted at least every 48 months. Trash must be in covered containers and removed regularly; no outdoor clotheslines are allowed. Property owners must maintain improvements for general appearance; failure may result in a lien for costs.
- Signs & advertising: No signs, billboards, or advertising structures are permitted except one sign not exceeding 2x3 feet advertising the sale or rental of the property. Subdivision development signs are also exempt.
- Parking & vehicles: No item or vehicle may be regularly stored or parked in areas dedicated to the public right-of-way or in easements dedicated as alleyways.
- Enforcement & liens: Any lot owner may sue to enforce these restrictions. The violating owner must pay attorney fees, court costs, and expenses, which become a lien on the property. The covenants automatically renew every 10 years and can be amended by a majority of owners.
