What Reflection Bay's governing documents say
Reflection Bay is a single-family homeowners association in Pantego, TX. This document is the Association's Assessment Collection Policy, which sets the rules for how homeowner assessments are collected when they become delinquent. It does not contain the full community rules (CC&Rs), so it only covers financial penalties and collection procedures.
- Payment due dates & delinquency: Regular assessments are due on the first of each month. An assessment is delinquent if not fully paid when due, and remains delinquent until paid in full, including all fees and interest.
- Late fees & interest: If full payment is not received by 5:00 p.m. on the late date set by the governing documents, a late fee and/or interest may be charged at the highest rate allowed by Texas usury laws. There is also a $30 fee for nonsufficient funds checks.
- Collection costs: The delinquent owner is liable for all costs the Association incurs in collecting the debt, including title reports, certified mail, court costs, filing fees, and reasonable attorney's fees.
- Payment plans: The Association must offer a payment plan to delinquent owners with a term between 3 and 18 months. The owner may be charged reasonable administrative costs and interest.
- Suspension of amenities: The Board may suspend a delinquent owner's (or tenant's) use of common area amenities if the account is delinquent for at least 30 days.
- Lien and acceleration: The Association may record an assessment lien against the property after notifying the owner. If an installment assessment is delinquent, the Association may accelerate the entire balance after 15 days' notice of default.
- What this document doesn't cover: This policy does not include any rules about pets, leasing, architectural review, parking, or other typical HOA restrictions. Those would be found in the full Declaration of Covenants, Conditions, and Restrictions (CC&Rs).
