What Whisperton's governing documents say
Whisperton is a single-family home subdivision in Arlington, TX, governed by restrictive covenants that run with the land. These rules bind all lot owners and are enforceable by any property owner. The document covers lot use, construction standards, and maintenance obligations, but does not create a homeowners association or set assessments.
- Land use & building restrictions: Lots are for single-family detached dwellings only. No subdivision or re-platting is allowed. No temporary structures (house trailers, sheds) without written Architectural Control Committee approval. No outbuildings except permanently constructed detached garages, gazebos, or storage buildings with committee approval. No structure may exceed two stories.
- Architectural standards: Main dwellings must have at least 1,800 sq ft of living area. Exterior walls must be at least 80% masonry, brick, or stone on the first floor (one-story homes) or 75% on two-story homes. Roofs must be 240 lb/sq heavy composition shingles with a minimum 8:12 pitch. All fences (wood, brick, wrought iron, or stone) require committee approval; fences cannot extend past the front or side walls and can be at most 6 ft high. All mailboxes must be brick and match neighborhood style.
- Yard maintenance: Grass, weeds, and vegetation must be mowed regularly to keep a neat appearance. Front yards must be sodded and have shrubs within 60 days of construction completion. Cactus or rock gardens are allowed only with succulent-like plants in a cohesive landscape plan. If the owner fails to maintain, the Architectural Control Committee may cut vegetation and place a lien for costs. All trash must be in covered containers and removed regularly; burning trash is prohibited.
- Utility requirements: Gas utility is provided as an amenity; each lot owner must install a gas line. Owners who want all-electric improvements may do so by paying a one-time $400 fee per lot at time of purchase from the developer.
- Signs & antennas: No billboards, advertising signs, or 'For Rent/Lease' signs are allowed. One 'For Sale' sign per property is permitted, no larger than 4x4 ft. No outdoor clotheslines or visible antennas (except CB or ham) are allowed.
- Enforcement & term: Any property owner can sue to enforce these covenants and recover attorney's fees. Invalidating one provision does not affect others. The covenants run for 30 years from recording, then auto-renew for 10-year periods unless two-thirds of lot owners vote to change them.
