What Barratt Lake Estates Homeowners's governing documents say
This document is the Bylaws of the Barratt Lake Estates Homeowners Association, a single-family HOA in Plano, TX. The Bylaws govern how the association is run — board elections, meetings, officer roles, and enforcement procedures — but do not contain the full set of community use restrictions (Covenants, Conditions & Restrictions or CC&Rs). Homeowners should refer to the Declaration of Covenants for rules on leasing, pets, parking, and architectural standards.
- Association governance & meetings: Annual meetings of members must be held during the third quarter of the fiscal year. Special meetings can be called by the President or by petition of at least 50% of Class A votes. Written notice of meetings must be mailed at least 4 business days in advance. A quorum is required to conduct business, and members may vote by proxy (proxies expire after 90 days unless a longer period is specified).
- Board of Directors: The Board manages association affairs. Directors serve 2-year terms and are elected by members after the developer-controlled period ends. Board meetings require at least 72 hours notice if given by phone or email, or 4 business days if mailed. Directors are not compensated unless approved by a majority of member votes, but may be reimbursed for expenses.
- Officers & committees: Officers (President, Secretary, Treasurer, etc.) are elected by the Board each year. The same person may hold multiple offices except President and Secretary. The Board may appoint committees as needed.
- Assessments & finances: The Board must prepare an annual budget, levy assessments, and collect them. Assessments are delinquent 15 days after the due date unless the Board specifies otherwise. The Association must maintain financial records, including monthly reports and an annual report (balance sheet, income statement, changes in financial position) available to members within 120 days of fiscal year end.
- Enforcement & fines: The Board may impose reasonable fines and suspend an owner's right to vote for violating the Declaration, Bylaws, or rules. Before imposing a sanction, the Board must give written notice describing the violation, the proposed sanction, a 10-day period to request a hearing, and a statement that the sanction will be imposed unless challenged. If a hearing is requested, it must be held in executive session. The Board may also use self-help (e.g., towing vehicles in violation of parking rules) and recover costs including attorney's fees.
- Amendments & conflicts: The Bylaws may be amended by members as provided. In case of conflict, Texas law prevails, followed by the Articles of Incorporation, the Declaration, and these Bylaws.
- Books & records: Members have the right to inspect the Association's records (Bylaws, Declaration, minutes, membership register, books of account) at the association's office upon reasonable request, subject to reasonable rules.
